1. Introduction

These Terms of Service (“Terms”) govern the use of all hosting, server, and domain-related services provided by Sitehandy Solutions (“we”, “our”, “us”).

By using our hosting, server, or domain services, the client (“you”, “your”) agrees to be bound by these Terms.

2. Services Covered

This agreement applies to the following services:

• Shared, reseller, VPS, or dedicated hosting
• Cloud or managed server solutions
• Domain name registration, transfer, and renewal
• Email hosting and DNS management
• SSL certificates and related technical add-ons

Each service may have additional policies (e.g., data center or registrar terms), which the client must also comply with.

3. Account Registration

1. Clients must provide accurate and complete contact information when registering for services.
2. Providing false or misleading information may result in suspension or termination.
3. Clients are responsible for maintaining the security of their login credentials and account access.

4. Service Usage Policy

1. You agree not to use the hosting or server for:
   • Sending unsolicited emails (spam)
   • Hosting or distributing malware, phishing pages, or illegal content
   • Running proxy servers, crypto-mining, or any resource-abusive scripts
   • Hosting content that violates copyright, trademarks, or applicable laws
2. Any violation of this policy may lead to immediate suspension or termination without refund.
3. We reserve the right to monitor server usage and enforce fair-use limits to ensure overall system stability.

5. Server Uptime and Maintenance

1. We strive to maintain 99.9% uptime, excluding scheduled maintenance or factors beyond our control.
2. Scheduled maintenance will be communicated in advance where possible.
3. We are not liable for downtime caused by external network issues, DDoS attacks, software bugs, or client-side misconfigurations.

6. Data and Backups

1. Clients are fully responsible for maintaining their own backups.
2. Sitehandy Solutions may offer automated backups as an optional or complimentary service, but does not guarantee data recovery.
3. We are not liable for any data loss resulting from client actions, hardware failures, or unforeseen incidents.

7. Billing and Payments

1. All invoices are issued according to the service plan subscribed.
2. Payments must be made on or before the due date stated on the invoice.
3. Services unpaid after the due date may be suspended or terminated after a grace period.
4. All payments made are non-refundable, including setup fees and renewals, except as required by law.
5. Domain renewals must be paid before expiry to prevent loss of ownership.
6. Late payments may result in additional administrative fees or reinstatement charges.

8. Domain Registration and Management

1. Domain names are registered under the client’s name where applicable.
2. Domain registration and renewal are subject to the policies of ICANN and respective registrars.
3. It is the client’s responsibility to ensure accurate WHOIS contact information and timely renewal.
4. Sitehandy Solutions is not responsible for domain loss, expiry, or transfer failures due to client inaction.
5. Domains may be automatically renewed if “auto-renew” is enabled in the client account.

9. Suspension and Termination

1. We reserve the right to suspend or terminate accounts for:
   • Non-payment
   • Violation of usage policies
   • Abusive or illegal activity
   • Excessive server resource usage impacting other clients
2. Termination will result in deletion of files, emails, and databases associated with the account.
3. Reactivation after suspension may incur a reinstatement fee.

10. Migration and Transfer

1. Free migration may be offered as part of new hosting accounts, subject to system compatibility.
2. We do not guarantee successful migration for outdated or incompatible systems.
3. Clients are advised to keep a full backup before and after migration.

11. Security and Access

1. Clients are responsible for securing their scripts, passwords, and software installations.
2. Outdated CMS, plugins, or scripts that cause vulnerabilities may be disabled or quarantined.
3. Sitehandy Solutions reserves the right to take preventive measures to protect the server’s integrity.

12. Limitation of Liability

1. Sitehandy Solutions shall not be liable for any indirect, incidental, or consequential damages including data loss, downtime, or lost profits.
2. Our total liability shall not exceed the total amount paid by the client for the affected service during the last billing period.

13. Service Modifications

We reserve the right to modify service features, pricing, or resource allocations with prior notice. Updated terms will be published on our website.

14. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of Malaysian courts.
