1. Introduction
Welcome to Sitehandy Solutions. These Terms and Conditions (“Terms”) govern your use of our products, services, and website.
By purchasing or using any of our services, you agree to be bound by these Terms. If you do not agree, please refrain from using our services.
2. Scope of Services
Sitehandy Solutions provides a range of IT-related services including but not limited to:
- Web hosting and server management
- Domain name registration and renewal
- Website design and development
- Web application and software development
- Mobile application development
- IT consultation and system integration
- Technical and corporate training programs
- Maintenance, upgrades, and IT support services
Each service may be subject to specific terms or agreements, which will prevail in case of any inconsistency with these general Terms.
3. Service Agreement and Payment
- All service engagements shall be confirmed through a quotation, proposal, or invoice issued by Sitehandy Solutions.
- Payment terms must be followed as stated in the invoice or quotation. Delayed payment may result in service suspension or cancellation.
- All payments made are non-refundable unless otherwise stated in writing.
- Domain names, hosting, and other recurring services must be renewed before their expiration date to avoid data loss or service interruption.
- Prices are subject to change with prior notice.
4. Client Responsibilities
- Clients are responsible for providing accurate, complete, and timely information required to deliver services.
- Clients must ensure that all content provided (text, images, videos, etc.) is legally owned or properly licensed.
- Sitehandy Solutions shall not be held responsible for delays caused by the client’s failure to provide necessary materials or approvals.
- Clients are responsible for the security of their login credentials and account access.
5. Intellectual Property
- Upon full payment, the client owns the final website, application, or deliverable created for them, except for third-party components, licensed software, or proprietary frameworks.
- Sitehandy Solutions retains the right to showcase completed works in portfolios, marketing materials, or case studies unless a non-disclosure agreement (NDA) is signed.
- All code, scripts, and design elements created by Sitehandy Solutions remain the company’s intellectual property until payment is made in full.
6. Hosting and Domain Services
- Sitehandy Solutions acts as a reseller or intermediary for hosting and domain services.
- Clients must comply with all relevant policies from upstream providers.
- Misuse of hosting accounts (e.g., spamming, phishing, malware distribution, illegal content) will result in immediate suspension without refund.
- Backup responsibility lies with the client, though Sitehandy Solutions may provide optional backup services.
7. Confidentiality
Both parties agree to keep confidential any information shared during the course of the project. Sitehandy Solutions will take reasonable measures to protect client data but shall not be liable for breaches caused by third-party actions or unavoidable incidents.
8. Limitation of Liability
- Sitehandy Solutions shall not be held liable for indirect, incidental, or consequential damages resulting from service use or failure.
- Our total liability shall not exceed the amount paid by the client for the specific service in dispute.
- We make no guarantee that our services will be uninterrupted, error-free, or entirely secure.
9. Termination
- Either party may terminate a service agreement with written notice.
- Upon termination, all outstanding fees must be settled.
- Sitehandy Solutions reserves the right to suspend or terminate services for violation of these Terms or any illegal activity.
10. Training and Consultation
- All training fees are payable in advance unless otherwise agreed.
- No refund will be issued for no-shows or cancellations within 7 days of the training date.
- Intellectual materials, slides, and resources shared during training are for participants’ learning purposes only and may not be redistributed or resold.
11. Support and Maintenance
- Support and maintenance services are provided based on the plan subscribed or as specified in the project scope.
- Additional support requests outside the agreed scope may incur additional charges.
- Maintenance or updates to third-party systems or plugins are subject to compatibility and license restrictions.
12. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
13. Amendments
Sitehandy Solutions reserves the right to amend or update these Terms at any time without prior notice. The latest version will be published on our website.
